Could I legally make and Sell a video game based on the manga Series Beserk?

No you can't, without the rights from the publisher of the manga. And you need a permission from whatever console you are making it from that console's producer. Expect it all to cost many thousands of dollars. If ya make it for PC, and freeware, then you can make it legally without these.

no you can't. You'd have to contact the producers and they'd probably want cash.

So from a legal perspective you just can't do it. Though I have to admit Berserk rules. Also there was already a game made for Berserk for the PS2 if I remember correctly

Well there is a gray area, You can make a game based off of trademarked material but you could not profit directly from it. IE. You can not charge a membership fee, you can not sell Items for the game, you can not sell ad space in the game, you can not have ads on any page that directly links to the game*, you can not profit in any direct use of the said Copyright materials. But you can accept donations, as long as there is no direct marketing.

*This is how it works you can not have ad's on any page that links to the game or that people have to go to in order to get to the game.

So,
Index --->Game
Index ---- >Games page -------> Game
So as long as none of the pages that people have to go through to get to the game have no Ads or Donation messages. Your Ok. So you need a link that says Support US and goes to a page that has a Donate Button - Is ok

What are you planing to program in?

If your planing on making a Console game then you can base it off of Berserk but you can not use any of the Plot or characters/ names from it.**

You can include easter eggs that do though as long as they are not part of the main game. As a homage to said martial.
